Ricky Don Kincaid, Charles William Luckie Johnson, Jr., Nhat Hoai Ngo, and Demian John Cratty were convicted of tax fraud. The four were charged with acquiring investors’ funds in Peyton Walher Financial Group, Wilcox Energy LLC, Trump Energy, LLC and other entities, converting those funds to personal income and failing to report the income to the Internal Revenue Service. Ricky Don Kincaid of Leander, Texas, was convicted on June 1, 2005 in the U.S. District Court in the Eastern District of Texas, Cause No. 4:04-CR-168. Kincaid was sentenced to 36 months in prison and ordered to pay $1,188,862.40 in restitution. Charles William Luckie Johnson, Jr. of Dallas, Texas, was convicted on July 1, 2005 in the U.S. District Court in the Eastern District of Texas, Cause No. 4:04-CR-169. Johnson was sentenced to 36 months in prison and ordered to pay $867,720.21 in restitution. Nhat Hoai Ngo, of Dallas, Texas was convicted on July 1, 2005 in te U.S. District Court in the Eastern District of Texas, Cause No. 4:04-CR-170. Ngo was sentenced to 24 months in prison and order to pay $867,720.21 in restitution. Demian John Cratty of Leander, Texas, was convicted on July 1, 2005 in the U.S. District Court in the Eastern District of Texas, Cause No. 4:04-CR-173. Cratty was sentenced to five years probation, including six months of home confinement and ordered to pay $374,138.08 in restitution.
