JOB DESCRIPTION:

The Texas State Securities Board is responsible for administering the Texas Securities Act, the statute that regulates the securities market in Texas.  This position is in the agency’s Enforcement Division, which is responsible for detecting and preventing violations of the Securities Act.  These violations include fraud committed in connection with the sale of securities, sales of unregistered securities, and sales of securities by unregistered dealers and agents. The Enforcement Division is also charged with pursuing appropriate administrative, civil, or criminal action against parties that violate the Securities Act.

This position is responsible for identifying and investigating violations of the Securities Act.  The attorney develops evidence by reviewing offering memoranda and financial records, secures subpoenas for documentary evidence, and interviews and takes testimony from witnesses. The attorney is also responsible for preparing administrative, civil, and criminal enforcement actions, and he or she participates in hearings, discovery, and negotiations, and litigates contested cases before the State Office of Administrative Hearings.  The attorney will manage a docket of cases and work collaboratively with other personnel on larger projects.

MINIMUM QUALIFICATIONS (License, Education, Experience):

The minimum qualifications require graduation from accredited law school with J.D. Degree. The candidate must either be licensed to practice law in Texas or awaiting results from the most recent Texas bar examination.  Other minimum qualifications include the following:

PREFERRED KNOWLEDGE, SKILLS, AND ABILITIES:

Working knowledge and experience with open records laws and processing of TPIA requests; Texas and/or federal legislative process; securities regulation or the securities industry. Recent (within the past 4 years) experience in any or all these areas.
